IMPORTANT FOR PEOPLE WHO STILL HAVE THEIR ORIGINAL ANALOG METERS: BE SURE TO OPT-OUT BY THE DEADLINE IN ANY SCE LETTERS YOU MAY HAVE RECEIVED, OR YOU WILL RECEIVE A SMART METER FROM SCE. ALL OTHERS (THOSE WITH SMART METERS) MAY OPT-OUT ANYTIME. OPTING OUT IS LIMITED TO ONCE PER YEAR, UNLESS YOU CHANGE RESIDENCES.
Some people are paying the opt-out fees separately, with their account number on the check as usual, but notating “Paid Under Duress” or “Paid Under Protest” on their checks, to indicate that they are being forced to pay the fees to obtain the opt-out and/or they disagree with the fees but must pay. The legality of the fees is being challenged at the CPUC and may become the basis for legal challenge in the courts.

Some of the problems we have heard of to date are:
1. long waits on the telephone to opt-out
2. long waits to receive opt-out analog meters for those with smart meters
3. SCE not contacting customer back when the customer has filled out and sent in the form or called, and was told that SCE will call them back
4. refusal to allow opt-0ut for a customer who said (on the phone to SCE rep) that she disagreed with the fees but would pay
5. interrogation-style treatment by SCE representative and his supervisor, of disabled customer who said she knew what the judge’s order was and that it was being allegedly violated on that phone call, that she had contacts with the CPUC.
